The Oder with legal personality? A draft bill proposes a solution that is unprecedented in Poland. Perhaps Poland will finally manage to expand the list of legal entities to include, for example, rivers, mountains, forests, etc., and grant them legal personality in line with New Zealand’s regulations. The concept of non-human legal entities is not alien to us; it merely requires a change in mindset and in the law.Under Polish law, elements of nature do not have legal personality. According to the Polish Civil Code, legal personality is held by the State Treasury and designated organisational units, whilst nature is treated as an object of protection rather than a legal entity. In Poland, elements of nature such as rivers, forests and mountains do not have legal personality. They have no rights or obligations; they may not own property, enter into contracts or act as a claimant in court on their own behalf. Nature is protected by specific legislation (e.g. the Nature Conservation Act or the Environmental Protection Act), under which the state or administrative bodies safeguard the interests of the environment, rather than bodies established to protect the interests of a specific entity, such as a river, a forest or a mountain. It’s time for change!!!
